Introduction

David undertakes a wide range of commercial work. Before coming to the Bar in 2001 he initially worked in industry and commerce after which he progressed to work in the field of international arbitration and mediation.

David has a broad practice at the Bar and accepts instructions on commercial disputes, personal injury and landlord and tenant matters. He is also a member of the Attorney General’s Civil Panel and as a consequence he is regularly instructed by Government Departments. As well as a litigation practice he also has a thriving commercial arbitral and mediation practice.

He is regularly instructed to deal with contractual, property and landlord and tenant disputes and his services, given his background, are particularly sought by those involved in commercial disputes within the construction and engineering sectors. He also regularly represents financial institutions when they are trying to make recovery following mortgage default.

He also has significant experience of representing the HMRC both in the specialised tribunal of the Tax Chamber and in the Civil Court on indirect taxation matters and on complex Missing Trader Intra-Community (MTIC) civil fraud cases.

Personal Injury

David has a wide range of experience within the field of personal injury representing both Claimants and Defendants in litigation involving employers and occupiers liability, road traffic accidents, factory and industrial accidents. He regularly represents Defendant Highway Authorities and Government Departments such as the Ministry of Justice, Ministry of Defence and the Highways Agency.

David represents parties in respect of CRU appeals and CICA applications. He also undertakes CFA work. He is a member of the Personal Injuries Bar Association and the Attorney General’s Civil Panel. David has significant experience and expertise in representing interested parties at Inquests and this is particularly so where Article 2 of the ECHR is engaged.


Fraud and Allegations of Fraud

David is instructed by Defendants and and insurers in cases where fraud is alleged or suspected and has substantial trial experience. David has particular experience with regards to road traffic claims involving allegations of staged accidents, induced accidents, bogus passengers and exaggerated claims with regards to quantum.

David has succeeded in persuading trial judges to make explicit findings of fundamental dishonesty in cases when acting on behalf of Defendant insurers.


Inquests & Coronial

David has developed considerable experience in representing all categories of interested persons at inquests which range from the family of the deceased to organisations who may have an interest in the outcome of the Inquest. As a member of the Attorney General’s Civil Panel he has represented a number of Government Departments and he has also represented the Police. David is also regularly instructed to represent insurers. As a consequence of his practice David is often involved with Inquests where Article 2 of the European Convention of Human Rights is engaged.
