Health & Safety, Corporate and Gross Negligence Manslaughter

Members of the Group are instructed on a broad range of matters including advising on compliance, appeals of enforcement notices and the prosecution and defence of a variety of matters, ranging from simple cases where minor injury has occurred to high-profile proceedings with complex factual and/ or legal matrices arising from catastrophic injury or fatality.

Our regulatory barristers are instructed on behalf of individuals ranging from sole traders to board members of listed companies and corporate entities, from small family-run businesses to household names operating across a variety of sectors including automotive, public transport, geriatric care and construction.

The Group also receives instructions to prosecute cases, including matters of particular gravity and complexity, on behalf of the HSE and numerous other prosecuting bodies including the Food Standards Agency and Local Authorities across the country.  Eleven members of the Group appear on the List of Specialist Regulatory Advocates in Health and Safety and Environmental Law.

Members of the group have been involved, on behalf of the HSE, in significant cases in the Court of Appeal relating to the approach to sentence and appropriate levels of fines: see for example Tata Steel [2017] EWCA Crim 104, Diamond Box [2017] EWCA Crim 1904 [2017], ATE Truck & Trailer Sales [2018] EWCA Crim 752 and Faltec [2019] EWCA Crim 520.

Members of the Group have participated in mock trials delivered on behalf of the clients of a leading global advisory, broking and solutions company and delivered lectures to the IOSH’s National Health & Safety Conference and provided training to HSE Officers.
