Appearing before Mrs Justice Lambert, Raghav Trivedi was successful in having the appeal dismissed on all grounds of appeal on behalf of Simon Williamson.

The appeal from the order of Master Sullivan of 10 February 2021 required the appellant (Mr Bone, a debtor) to pay the costs of the respondent (Mr Williamson, a High Court Enforcement Officer) in Mr Bone’s application under paragraph 16 of the Taking Control of Goods (Fees) Regulations 2014 (the “TCG (Fees) Regulations”).

The appeal centred around the question of whether or not a High Court Enforcement Officer is an appropriate Defendant to a dispute over fees levied by an Enforcement Agent under the Taking Control of Goods (Fees) Regulations 2014. The Court found that a High Court Enforcement Officer, as opposed to an Enforcement Agent, is not an appropriate Defendant to a dispute over fees levied by an Enforcement Agent and that an Enforcement Agent does not act as Agent for the High Court Enforcement Officer but on their own behalf.
