Ben Mills defends in five-year perverting the course of justice investigation

This week, a five-year investigation and prosecution of a Health and Safety Manager and two directors accused of perverting the course of justice came to an end when Ben Mills argued for the charge to be dismissed.

The case involved an allegation that senior staff at a civil engineering business had created and back-dated policy and procedure documents intending to mislead to HSE into thinking the documents existed at the time of a workplace accident to discourage the HSE from commencing criminal proceedings against the company. Following two days of legal argument, the court concluded that the prosecution case was insufficient for any of the defendants to be properly convicted.

Ben acted for the Health and Safety Manager, instructed by Ben Henry of Jonas Roy Bloom, led by Jim Sturman KC of 2 Bedford Row who assisted with the written arguments.

Mark Cotter KC of 5 St Andrew’s Hill, instructed by Nick Dent of Mishcon de Reya, and Graham Brodie KC of 33 Chancery Lane, leading Kevin Saunders of 23 ES Chambers, also instructed by Ben Henry, acted for the co-defendants.
