Duties, Consultation and Occupation: TOLATA beyond Declarations and Orders for Sale – Christopher Buckingham

Christopher will examine TOLATA beyond its most common deployment in implied trust claims and for purposes of seeking an order for sale. The talk will look into a number of issues governed by TOLATA, with consideration being given to its relationship with pre-existing equitable principles. Subjects will include the trustee’s powers under s.6, the existence or otherwise of consultation requirements, and the often contentious issue of occupation rights (as well as whether compensation should be paid).

Whose Asset is it: Partnership or Personal? – John Aldis

In this talk, John Aldis will discuss:

  • The distinction between holding land as an asset of a partnership and using land personally owned by a partner;
  • The relative merits of holding land in one way or the other; and
  • How to resolve disputes over how it is held.

Shadows of Risk: Right to Light Issues in Property Development – Michelle Caney

Michelle Caney will explore the legal and practical challenges that right to light issues present in development projects. With a focus on recent case law and remedies post Cooper v Ludgate House Limited [2025] EWHC 1724, she will examine when an interference may be actionable and what relief may flow. Michelle will also provide practical guidance on how to mitigate exposure through early risk management and strategic advice.

Firing the Starting Gun: When and How to Deal with Urgent Injunctions in Property Litigation – Anya Newman

Whether it’s a trespass amounting to a full-scale takeover, a blockade to a right of way or the neighbour’s demolition project being undertaken in a dangerous way, the chances are you’ve been asked to consider whether an urgent injunction could be obtained. These remedies are vital, but making an application incorrectly can have serious cost consequences. Anya Newman will consider the law and procedure surrounding when and how to apply for such an injunction including practical tips and real-life experiences.

Drawing the Line: The Role of Experts and Extrinsic Evidence in Boundary Disputes – Panel Discussion

Boundary disputes often turn on fine margins but quickly escalate into costly, entrenched litigation. In this panel discussion, leading practitioners will explore and debate the critical role of expert evidence and extrinsic material in determining boundary positions when the conveyancing documentation is unavailable or unclear.

Dilapidations: A Masterclass in Principles and Practice – David Nuttall

David Nuttall will be considering a terminal schedule of dilapidations and highlighting the various vulnerabilities it contains.  This will include a detailed consideration of the ambit of repair covenants and what constitutes an improvement over a repair.  These are essential considerations in both dilapidations and a wider disrepair context.  He will also work through practical issues, such as the impact of licences for alteration and general evidential difficulties in litigating dilapidations claims.  David will finally touch on s18 Landlord & Tenant Act 1927 – what covenants will it cover, and when a landlord’s intention to repair becomes relevant.

The Expert Edge: Strategies for Success in Dilapidation Disputes – Christopher Sullivan, Hollis Global

Our Guest Speaker, Chris Sullivan, will cover practical tips for litigators and clients when dealing with dilapidations claims. He will share his experiences on when and how to instruct an expert to get the best out of them, expectations on court experience, acting as an advisor or an expert, practical challenges, alternative repair options and supersession arising from building improvements such as MEES compliance.

Dilapidations in Action: Case Study and Workshop – Harry Marriott, Alexander Bradford & Charles Towl

As part of an interactive session, Harry Marriott, Alexander Bradford and Charles Towl will explore the issues that commonly arise in dilapidations claims. Through the lens of a case study, delegates will look at the substantive issues that arise in dilapidations claims and the remedies that may follow
