Real Estate

Our Real Estate Barrister Team is recognised year on year by the leading directories for the quality of its work.  The team uniquely boasts band 1 status for Real Estate Litigation in the Midlands and many of its members have earnt personal plaudits, not only in Chambers UK but also in the Legal 500.

We understand that clients demand specialist knowledge from barristers who are not only first-class advocates, but also approachable and practical in their advice. Our Real Estate Team backs this with dedicated professional clerking that is client-focused and responsive.

Real Estate Barrister Team members all have in-depth experience in property work. The span of work is comprehensive, including:

  • Adverse Possession and boundary disputes
  • Charges and mortgages
  • Conditional Contracts and Options for development land
  • Co-operation agreements and overage
  • Easements and profits
  • Land registration and unregistered titles
  • Recovery of land and trespass
  • Restrictive covenants
  • Sale and purchase contracts and their construction
  • Trusts of land and equitable interests

The strength of the Real Estate Team is built on the quality of its membership, which is well-recognised nationally.  The team’s membership includes barristers who have been appointed as a Deputy High Court Judge, Recorders, a Property Chamber Tribunal Judge in both Land Registration and Residential Property divisions, and a Deputy District Judge. The clerks, too, have earned plaudits: “A very good clerking team, led by Joe Wilson. They are flexible, muck in and are friendly to deal with.”

Recent commentary also includes this: “an outstanding set offering specialist expertise across a plethora of property matters, including boundary disputes, professional negligence, landlord and tenant conflicts and easements and covenants. Its members frequently handle complex cases that make their way to the Court of Appeal” (Chambers UK Bar).

The law reports listed with member profiles reflect the work undertaken by the team in the higher courts: not only a good deal of reported cases in the High Court and Court of Appeal but also including cases proceeding to the Supreme Court. Members also contribute to publications, including the Solicitors Journal. Seminars are frequently also provided to solicitors and their professional clients.
