The topics to be explored in the morning include recent developments in the law of adverse possession and restrictive covenants and a tripartite series focusing on the validity and service property notices – essential to any property practitioner’s practice.
The afternoon will focus on commercial property starting with a masterclass on lease renewals both from a legal and an expert’s perspective.
The conference will be rounded up with an interactive case study, intended to give delegates a better understanding of the relative strength of their evidence in lease renewal and leasehold valuation cases.

Keynote Address – HHJ Williams
HHJ Williams is the lead BPC Judge in Birmingham. HHJ Williams qualified as a solicitor in 1992 and worked at Eversheds LLP. He was appointed as a District Judge in Birmingham in 2010 where he specialised in Chancery/BPC work. He was appointed as a Circuit Judge in 2018. In October 2020 he was appointed as a Specialist Senior Circuit Judge sitting in Birmingham and authorised to sit as a High Court Judge in the Chancery Division, Circuit Commercial Court, TCC, Administrative Court and Upper Tribunal Immigration and Asylum Chamber.

Anthony Verduyn, the Head of our Business and Property Group, will open the substantive programme by looking at current issues and practice in the developing law of adverse possession, focusing on the real world operation of the Land Registration Act 2002.

Raghav Trivedi
Raghav Trivedi will provide an overview of the factors concerning the validity of property notices, along with the principles of construction for determining whether a notice is valid. Raghav will utilise his case experience and case studies to help provide an understanding of the practical and tactical application of these fundamental matters. This will also involve a consideration of the potential traps and pitfalls for the unwary.

Iqbal Mohammed
Iqbal will look at methods of serving notices as well as contemporary issues such as service by email where the lease contains antiquated methods. Iqbal will also consider the position from a drafting perspective and look at why certain methods of service are preferred. Iqbal will look at important decisions relating to service.
Saving Notices – What to do When Things Go Wrong
Harry Marriott
Harry Marriott will consider alternative arguments which can be used when a property notice may be found to be invalid. In particular, Harry will look at whether notices can still be given their intended effect by mechanisms such as waiver and estoppel, how practitioners can be best placed to rely on or resist these arguments, and practical tips on remedying situations where errors have occurred.
