Simon Phillips and Marcus Harry successfully appeal against trial judge's ruling

Simon Phillips and Marcus Harry successfully appealed against a trial judge’s ruling that there was no case to answer against 6 defendants in a trial involving protest action on private land.

The Court of Appeal provided guidance on the interpretation of section 78(1) and (4) of the Police, Crime, Sentencing and Courts Act 2022. The case involved a novel point of law never before considered by the Court of Appeal.
