The Court of Appeal will next week hear three conjoined appeals dealing with legal parentage.

The court will consider the impact of a declaration of non-parentage in the case of a man not married to a child’s mother, who is named on the child’s birth certificate but who is subsequently proved not to be the child’s biological father.

Questions arising include whether such a declaration renders the individual’s parental responsibility void ab initio or whether his PR can only be removed by order of the court. Furthermore, if an order is needed, is the court required to undertake a welfare analysis before making such an order?

William Horwood and Lauren Starmer act as junior counsel for the mother in one of the appeals, together with Daniel Taylor and led by Shiva Ancliffe KC both of Coram Chambers.
