The record hot summers of 1975 and 1976 brought a flurry of claims relating to the insidious damage to property caused by roots from nearby trees and caused the law to be clarified and developed. Last week the press announced that 12 million trees are to be planted across England by 2022, the equivalent of 18 Sherwood Forests including 1 million in towns and cities. Combine this with regular droughts, particularly in the southeast from global warming and the number of tree root claims can only rise. This is quite apart from rarer cases of personal injury and damage claims from falling trees. This article examines the law relating to tree claims.
