Simon Clegg will discuss issues relating to the operation of break clauses commonly litigated with a view to assisting those involved to continue to have carefree laughter, not tears in their eyes.
11.40am-12.20pm Session 2: Anya Newman
Forfeiture Revisited
In these challenging economic times, defaulting on lease terms is sadly common. Anya Newman will take a look at the recent slew of decisions on forfeiture. This session will consider what landlords can do to strengthen their position in forfeiture matters and areas of weakness which may allow tenants to challenge or avoid losing their leases in this famously draconian manner.

We’ve exchanged, but it’s all going wrong!
Gavin McLeod will discuss various matters arising upon and as respects the contract for sale after its execution and before completion has occurred. Taking the various remedies potentially available and comparing their different features and effects, an attempt will be made to weigh up potential pros and cons. Observations will also be made on the effect of any completion on the prior contractual position.

Navigating Change: The Key Implications of Upcoming Reform
Angus Thomas will provide a comprehensive overview and practical guidance in relation to recent and proposed statutory reforms shaping the property landscape. Angus will consider the Leasehold and Freehold Reform Act 2024, exploring its impact on enfranchisement, ground rents, and lease extension rights. The Renters’ Rights Bill will be analysed in relation to the abolition of Section 21, and further changes affecting landlords and tenants. Finally, Angus will discuss the Business Tenancies Consultation, that considers potential reforms to commercial lease renewals and security of tenure.
2.30pm-3.00pm Session 5: Alexander Bradford
Procedural Update and Taking Notice of Khan v D’Aubigny [2025] EWCA Civ 11
The new intermediate track has created a degree of uncertainty. Alexander Bradford will focus on how property cases may get allocated to this new track. He will also provide a general overview of CPR updates for property litigators, as well as the fundamental question of what is a “notice”, following the Court of Appeal’s judgment in D’Aubigny.
