Dealing with lengthy Delays to Hearings

The large number of Employment Tribunals that are being adjourned at the moment due to the unprecedented working conditions we’ve all been placed under is adding to the stress of the extraordinary situation we are living through.

We are acutely aware that many of our clients – claimants and respondents – will be very concerned about the delay to completion of their claims.

It is particularly unfortunate that this latest crisis comes off the back of the period where most Tribunals were already struggling to clear a backlog of cases that had been waiting months to be heard.

We know that settlement may well be in the mind of many parties and their representatives at this time.  Of course, settling cases is something that is part of the usual workload of most employment solicitors, but there may be cases where assistance is needed.

St Philips Employment Team has been thinking about ways in which we can offer that assistance to our clients, and would like to remind you that we can offer the following services –

Mediation: If you or your client would prefer or need somebody independent to conduct negotiations, St Philips Employment Team has a number of individuals who are qualified mediators who would be able to assist with the settlement of claims via telephone or video conferencing mediation.

Members offering this service include Sophie Garner (CEDR and ADR Group qualified, Globis Workplace Mediator trained) and Robert Mundy (ADR Group qualified).

Settlement agreements: Particularly where claimants are litigants in person, assistance may be needed to advise Claimants as to the terms of any settlement agreement reached.

Grievance and Disciplinary Investigations: St Philips Employment Team members are also able to assist if any of your clients are in need of an impartial and independent investigator to complete a thorough investigation or determination of grievance and disciplinary matters
