The University of Birmingham v (1) Persons Unknown and (2) Mariyah Ali [2024] EWHC 1770 (KB): Key protest encampment case raising issues of significance to the whole of the University sector, including whether Universities should be regarded as public authorities under the Human Rights Act 1998 and are susceptible to public law defences. The University also faced a defence of direct discrimination. This is the first reported case where such an argument had been pursued in respect of a protest encampment. Acted initially as sole counsel and subsequently as led junior.
The University of Nottingham v (1) Butterworth and (2) Persons Unknown [2024] EWHC 1771 (KB): Summary campus wide possession order obtained in respect of a protest encampment at the Jubilee Campus. Procedurally important as the judgment confirms that it is permissible to issue claims for possession against unknown occupiers simply against persons unknown: CPR 55.3(4). It was therefore not necessary to define persons unknown by way of descriptions as with injunction claims.
Scalora v Clarion Housing Association Limited [2024] EWHC 1414 (KB): In a case which attracted national media coverage, Michelle secured the dismissal of a £1.1m claim for unlawful eviction following a 9-day trial in the High Court. The case involved cyber expert evidence and multiple allegations of fraud and forged documents.
Wolverhampton City Council and others v London Gypsies and Travellers and others [2023] UKSC 47: Landmark decision in which the Supreme Court ruled that the court has jurisdiction to grant a wholly new type of injunction against Persons Unknown: ‘the newcomer injunction’. This judgment gives an in-depth analysis that clarifies the approach which should be taken in respect of such applications. Acted as led junior for the successful respondent, Wolverhampton City Council.
Dudley Metropolitan Borough Council v Mailley [2023] EWCA Civ 1246: Acted as leading junior (leading Eloise Marriott) for the successful respondent. The Court of Appeal comprehensively rejected all grounds of appeal and upheld the High Court’s decision that the succession legislation is compatible with Article 14 ECHR.
London Borough of Barking and Dagenham and Others v Persons Unknown [2022] EWCA Civ 13 (CA): Acted as led junior in an appeal to the Court of Appeal brought by various local authorities concerning the nature and scope of the court’s jurisdiction to grant injunctions against Persons Unknown.
Dudley Metropolitan Borough Council v Mailley [2022] EWHC 2328 (QB): High Court possession claim. Acted for the successful claimant in rebutting a novel Article 14 incompatibility argument as well as a public law challenge and an Article 8 defence. This decision was upheld by the Court of Appeal.
Northamber Plc v (1) Genee World Ltd (In Liquidation) (2) Ranjit Singh (3) Interactive Education Solutions Ltd [2020] EWHC 31: Commercial committal trial in the High Court, in which Michelle acted for the company director. Guidance given on when a company director may be guilty of contempt for the company’s default.
Wolverhampton City Council v Persons Unknown [2020] EWHC 2280 (QB): Review hearing of an injunction granted against Persons Unknown. The High Court was satisfied that the claimant had complied with the significant guidance given by the Court of Appeal in Bromley LBC v Persons Unknown [2020] EWCA Civ 12.
Wolverhampton City Council v Persons Unknown [2018] EWHC 3777 (QB): High profile claim concerning the politically sensitive issue of dealing with unauthorised traveller encampments. Secured an injunction to protect 60 sites in Wolverhampton.
In the Matter of an Application to Register as a Town or Village Green Land known as Rokeby Playing Fields, Rugby, Warwickshire (Application Reference 300/159): Village Green Inquiry at which Michelle was appointed as the Independent Inspector for a local authority to determine whether land had become a village green.
Shakilal Abdur Rehman and Anor v Mohammed Ali and Ors [2015] EWHC 4056 (Ch): 17 day possession trial in the High Court concerning whether a Mosque was held upon trust for the local community. Acted as sole counsel for the successful claimants. The defendants were represented by a leading silk and two juniors.
Wolverhampton City Council v Shuttleworth [2012] LTL 13/12/2013: High Court appeal raising a novel point of law concerning the introductory tenancy scheme.
