Mark Grant recently obtained an injunction against Persons Unknown, on behalf of the owners of the Three Counties Showground in Malvern, Worcestershire. 

The application related to a Defence and Security Expo due to take place at the Showground in November, and follows substantial protests at last year’s event by Extinction Rebellion and other groups. 

The application was opposed by counsel representing a number of Interested Persons, but after a full-day hearing Mr Justice Spencer granted the injunction in the terms sought. He was satisfied that it was appropriate and necessary to grant the injunction to prevent trespass and nuisance, and that to the extent any protest took place on the public highway the interference with ECHR rights was justified.

The law relating to injunctions against persons unknown has developed substantially in recent years, and such injunctions are increasingly sought against, for example, protesters, trespassers and ticket touts.
