Sarah Harty recently represented David Wade, a former poultry farming equipment salesman, in an Employment Tribunal.
The Tribunal found that Mr Wade had been unfairly dismissed. No fair process had been followed and the Tribunal held that the real reason for his dismissal was not poor performance as alleged but because Mr Wade had asked to be paid his bonus. The Tribunal further ruled that it was reasonable for Mr Wade to reject his employer’s offer to extend his notice period after he was unfairly sacked and berated. The tribunal awarded Mr Wade £39,000.
