Ben Williams has prosecuted two companies in a Health & Safety case at Newcastle Crown. The sentencing judge determined that the first defendant, Tolent Construction Limited’s breach of construction safety regulations merited a fine of £1m, but the company had gone into administration during the proceedings and so was fined £1000 and ordered to pay costs of just under £8,500. The second company was fined £12,000 and ordered to pay £45,000 costs.
The prosecution was brought after a worker sustained life-changing injuries when a 124kg structural panel fell on him during craneage. Both companies ultimately admitted failures to plan, manage and monitor the construction activities properly and were sentenced on 17th April 2023.
