Judgment was today handed down in Gill v Thind [2023] EWCA Civ 1276, an appeal challenging a trial judge’s finding that the appellant held shares in a care-home company on oral trust for his grandchildren. Lord Justice Peter Jackson, Lady Justice Asplin and Lord Justice Arnold unanimously dismissed the appeal, concluding that the trial judge had made no error of law.
John and Rob, instructed by Morgan Rees and George Gwynn of George Green LLP, represented the successful respondents, both at the appeal and at the 11-day trial [2022] EWHC 2872 (Ch). Before that, John and Rob represented the respondents at a number of interim hearings, including successfully resisting an application for a freezing order and successfully resisting an application to pursue derivative claims [2020] EWHC 2973 (Ch).
The Court of Appeal refused the appellant’s application for permission to appeal to the Supreme Court.
