Amanprit Kaur successfully defends Beneficial Interest Claim in Complex Possession Proceedings

Amanprit Kaur acted for Deputies appointed under a Court of Protection Order in complex multi-track possession proceedings concerning an alleged beneficial interest in a residential property.

The Defendant advanced claims in constructive trust and proprietary estoppel arising from an alleged contribution towards the purchase price and long-term occupation of the property. The counterclaim was dismissed in full, with the Court finding the sum paid was a loan and insufficient to establish any beneficial interest.
