Some of you may have already mediated on matters by phone or video and so will be familiar with the process.  However, given that access to the courts is limited, litigating parties may decide to make an extra effort to resolve disputes though negotiation and virtual mediations can offer a simple and cost-effective solution.

Our mediators are all able to conduct a mediation while the parties all remain at home through the Zoom platform.  The platform is simple and offers benefits such as:

  • Flexible time frames that will allow mediations to be held at time that suits the  parties, taking in to account the issues we all have of unusual working patterns while operating from home
  • The ability to have focussed, time limited mediations
  • Mediations can be broken down in to several sessions done over a day or multiple days
  • Main communal video conference with additional private breakout rooms assigned for each parties to discuss matters separately and confidentially.
  • integrates directly with Dropbox to allow us to share and receive files as you go
  • The calls are able to be recorded, securely to the cloud and shared immediately after a call has concluded
  • The mediators screen can be shared allowing documents to be viewed in real-time between parties.

Virtual Mediation Fee Structure

The fixed fee brackets below provide a flexible fee structure, taking in to account the value of the claim for quantified claims.  They are given on the basis of a fixed base fee per party for the day of the mediation, with our individual mediator’s charges being dependent upon their seniority and experience.  The clerks can discuss with you the suitable mediators in order to reach a price point that you are happy with.

Additional charges will be made for mediator time over and above the inclusive hours on the day of the mediation.  Plus if the mediator is asked to consider a large amount of material (in excess of 300 pages) or to participate in pre-mediation contact that then exceeds the 90 minutes of inclusive preparation time.  Such circumstances will result in that time being charged at the prescribed hourly rate.

Time Limited Virtual Mediation (4 hours)

Valuation of Claim Cost to each party(subject to which mediator engaged)
Up to £50,000 £400-£500 plus VAT
Up to £100,000 £450-£800 plus VAT
Up to £250,000 £500-£900 plus VAT
Hourly rate for additional time engaged £100-£150 plus VAT

Full Day Virtual Mediation (7 hours)

Valuation of Claim Cost to each party(subject to which mediator engaged)
Up to £50,000 £600-£800 plus VAT
Up to £100,000 £675-£1,100 plus VAT
Up to £250,000 £750-£1,250 plus VAT
Hourly rate for additional time engaged £100-£150 plus VAT

Disputes covered by our fixed fee structure

Disputes NOT covered by this agreement

  • Cases between more than two parties.
  • Unquantified claims.
  • Disputes with either a claim or counterclaim in excess of £250,000.

All of these disputes can be mediated but fees are to be agreed on a case by case basis with the clerks.

Small Claim Mediations

In addition to the above we are able to mediate on Small Claim matters.  These will be done by our newer mediators for a fixed fee of £250 plus vat for a 90 minute mediation.  Please speak with the clerks to discuss suitability.
