Lexis PSL – Dispute Resolution analysis: Dr Mirza Ahmad, barrister at St Philips Chambers, provides his views on the judicial review amendments made by the Criminal Justice and Courts Act 2015 (CJCA 2015), which are due to come into force on 13 April 2015.
In his article, Mirza issues a word of caution, as section 31 and schedule 16 of the Senior Courts Act 1981 are being amended by the CJCA 2015. CJCA 2015, ss 84-90, and the pre-action protocol for judicial review, are also being revised to reflect the 2015 legislative changes. The legislative changes will introduce additional thresholds to be met by claimants before the courts will grant leave to apply for judicial review or actually grant judicial review relief.
