Introduction

Juliet Allen is a matrimonial finance and family trusts specialist. She is experienced at dealing with financial remedy applications at all stages, from interim applications including maintenance pending suit and avoidance of disposition through to multi-day final hearings and appeals.

Family Finance

Juliet’s practice includes cases involving complex business arrangements, unusual trust structures, analysis of business accounts, farming cases and cases in which there are issues of non-disclosure or dissipation of assets. Juliet has a particular interest in cases in which trusts issues arise within financial remedy proceedings and will accept instructions in relation to cohabitee disputes pursuant to the Trusts of Land and Appointment of Trustees Act 1996 and applications for financial provision pursuant to Schedule 1 of the Children Act 1989.

Notable Cases

Juliet appeared in the Court of Appeal as Junior Counsel for the appellant in Moher v Moher [2019] EWCA Civ 1482  and for the respondent in JE v ZK [2015] EWHC B87.

Other recent cases include:

  • C v C: a three-day case involving substantial business assets and arguments as to non-matrimonial property and company valuation. Juliet successfully cross examined a single joint expert accountant over a day of court time and secured a very favourable outcome for her client.
  • W v W: a case involving parties who held assets in excess of £5million in their own names and were also beneficiaries of large discretionary family trusts. There was also an issue as to a potential post-separation accrual of several million pounds within a family company.
  • Representing a footballer in relation to a Schedule 1 application.
  • M v M: defending a Notice to Show Cause in which it was asserted that the parties’ respective solicitors had reached an agreement between themselves in correspondence.
  • T v T: representing a husband in relation to a financial remedy application where the vast majority of the family wealth was derived from a Clinical Negligence payment received by the husband after failings by medical staff had led him to suffer life changing injuries.
